Introduction

These Terms of Service ("Terms") establish a legally binding agreement between you ("User," "you," or "your") and CMM Interiors LLC ("CMM Interiors," "we," "us," or "our") regarding your access and use of our website (https://www.cmm-interiors.com) and services ("Services").

Please carefully read these Terms before using our Services. Your access and use of the Services indicates your acceptance of these Terms.

1. Services

CMM Interiors offers Residential Interior Design. These services may be modified or expanded at any time.

2. User Accounts

  • You may be required to create a user account to access certain Services.
  • You are responsible for keeping your account information accurate and secure.
  • CMM Interiors may suspend or terminate your account for any breach of these Terms.

3. Acceptable Use

  • You must use the Services only for lawful purposes and in accordance with these Terms.
  • You must not use the Services in ways that:
    • Infringe on the intellectual property or rights of others
    • Are harmful, fraudulent, threatening, abusive, or harassing
    • Violate any law or regulation
    • Disrupt or interfere with the Services
    • Spam or send unsolicited communications

4. Intellectual Property

  • The content on our Services, including text, graphics, logos, software, and any other materials, is owned or licensed by CMM Interiors. You may not use this content without our express written permission.
  • You grant CMM Interiors a non-exclusive, worldwide license to use any content you provide through the Services (such as feedback or reviews) for the purposes of operating and promoting our business.

5. Fees and Payment

A flat-rate design fee will be charged once the contract is signed for time involved in online or in person design: research/sourcing, ordering/procurement, conceptual and/or technical designing and drawing, specifications of finishes, supervising or coordination of trades or design assistants, installation, and general design consulting regarding renovating or decorating for the property project. All design fees are non-refundable.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CMM INTERIORS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

CMM INTERIORS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR SERVICES IN THE PRECEDING 12 MONTHS.

8. Indemnification

You agree to indemnify and hold CMM Interiors harmless from any claims, losses, or expenses arising out of your use of the Services or any breach of these Terms.

9. Changes to Terms

We may change these Terms at any time, and your continued use of the Services after changes are posted indicates your acceptance of the new Terms.

10. Governing Law

These Terms will be governed by and interpreted within the laws of the State of New Jersey, United States, without regard to conflict of law principles.

11. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiation. If negotiation fails, the dispute shall be resolved through mediation in Morristown, New Jersey.
